Theory of Compliance

This course aims to give participants an understanding of what compliance is all about in law and beyond law, why understanding compliance is central for the European regulatory framework – the Artificial Intelligence Act and the Digital Services Act – in handling the potential risks of AI and the platform economy.

The first half looks at compliance in behavioural economics and law, why compliance to regulating artificial intelligence, the tools the EU is using in the regulation of Artificial Intelligence, who the responsible actors are, and what kind of monitoring and surveying duties lie in private hands and what remains for the public national public authorities, the European Commission and civil society organisations.

The second half begins with highlighting the particularities of the platform economy and its impact on the society, then using the DSA to dive deeper into three crucial fields – the due diligence obligations under the DSA, the transferal of due diligence obligations into terms and conditions, advertising and auditing, and the tools available for individuals to launch complaints as well as the competences of the European Commission in enforcing the DSA.
